1. Introduction and Acceptance of Terms

Welcome to Fate. The Service is operated by Intuitique LLC, a Wyoming limited liability company with its registered office at 1309 Coffeen Avenue STE 17670, Sheridan, WY 82801, United States of America (referred to as "Fate," "we," "us," or "our"). These Terms & Conditions ("Terms," "Agreement," or "EULA") govern your access to and use of all features, functionalities, content, and services available through our website and applications at getfate.app (the "Service" or "Platform").

By creating an account, accessing the Service, purchasing a subscription, or otherwise using Fate, you (the "User," "you," or "your") agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated by reference. If you do not agree, do not access or use the Service.

Important: all content provided through Fate is for entertainment and personal reflection purposes only. It is not professional advice and is not a substitute for medical, psychological, financial, legal, or relationship guidance. See Section 3 for details.

We may modify these Terms at any time. For material changes, we will notify registered users by email and/or in-product notice at least fifteen (15) days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you must stop using the Service before the effective date and may cancel your subscription in accordance with Section 5.

2. Eligibility and Accounts

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use Fate. We may require age verification at our discretion. The Service is not directed to children, and we do not knowingly collect personal data from anyone under 18.

You may create only one account per person. You must provide accurate and complete information at registration and keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorised access or suspected security breach via contact@getfate.app.

You may not: (a) create multiple accounts; (b) share, sell, or transfer your account; (c) provide false information; (d) impersonate any person or entity; (e) circumvent our authentication, billing, or security measures; or (f) access the Service through automated means (bots, scrapers) without our prior written consent.

3. Description of Services

Fate is an astrology, relationship, and personal-reflection service. The Service provides personalised astrological content, relationship-focused insights, and guided self-reflection experiences, which may include daily and personalised horoscopes, natal and birth-chart analysis, compatibility and synastry reports, relationship guidance content, numerology, palmistry and astrocartography readings, and Karmic Clearing — a personalised karmic-pattern report, a free interactive release ritual, and an optional paid 30-Day Clearing Path — together with related esoteric content and tools.

Certain experiences, such as the daily release ritual, are made available without charge and may be subject to usage limits (for example, once per day). Specific features available to you depend on your subscription plan and any one-time purchases, and may change over time. We may add, modify, or remove features in our reasonable discretion, with notice where required by Section 13.

The Service is intended for entertainment and personal reflection purposes only. Astrological content, compatibility analyses, relationship guidance, and any other interpretations provided through the Service are not scientific predictions, not guarantees of any outcome, and not professional advice. They are based on traditional astrological and esoteric practices, which are not empirically validated. The Service is not a substitute for professional medical, psychological, financial, legal, or relationship counselling, and you should not make significant life or relationship decisions based solely on content provided through the Service.

Reflective practices offered through the Service — including release rituals, manifestation or "calling-in" exercises, and the Clearing Path — are tools for personal reflection only. They are not therapy or treatment, and we do not promise or guarantee any particular result, outcome, or change in your circumstances, including in your relationships, finances, or wellbeing.

We do not guarantee any specific outcome, accuracy, or result from the use of the Service. Individual experiences and interpretations will vary.

4. Methodology and Tools

In preparing and delivering content, Fate uses a combination of proprietary methods, third-party software, and modern technologies, including automated and AI-assisted systems, to generate, draft, analyse, and quality-review the content we provide. Content is produced programmatically rather than by human astrologers or psychics. Fate remains responsible for the content and quality of the Service it provides.

The categories of third parties that process your information in connection with the Service are described in our Privacy Policy. We do not share or submit User information to any third-party tool, service, or platform except as described in that Policy and under appropriate contractual safeguards.

5. Subscription, Trial, and Billing

5.1 Trial Period

Fate offers a 7-day trial which provides access to premium features. During sign-up, you may be offered one or more trial pricing options. The trial price you select (or, if no option is offered, the default trial price displayed at checkout) is charged immediately upon sign-up via your selected payment method. Only one trial is permitted per user, household, or payment method. Eligibility for the trial may be limited or denied at our discretion, including where we detect repeat trial activity.

5.2 Conversion to Subscription

Unless you cancel before the end of the 7-day trial period, your trial will automatically convert into a paid recurring subscription at the standard plan price displayed at sign-up. Your first subscription payment is charged at the end of the 7-day trial, and you will then be charged once every 28 days thereafter until you cancel.

5.3 Recurring Billing

After the trial converts, your subscription renews automatically once every 28 days at the then-current rate for your plan, until cancelled in accordance with Section 5.6. By subscribing, you authorise Fate (and our payment processor) to charge your payment method for each 28-day billing cycle.

5.4 Pricing, Taxes, and Currency

Subscription prices are shown at sign-up in your local currency where supported (currently USD, GBP, EUR, AUD). All prices include applicable taxes (VAT, GST, sales tax) where required by law, and the final amount is displayed before checkout. Currency conversion charges, if any, are determined by your bank or card issuer and are not refundable by Fate.

5.5 Add-Ons and One-Time Purchases

Certain features, content packs, or premium experiences (for example, individual compatibility reports, extended natal-chart analyses, or the 30-Day Clearing Path) may be available as one-time purchases or paid add-ons in addition to, or independently of, your subscription. One-time purchases are charged once and do not automatically renew. Pricing for each add-on is displayed before purchase. Add-ons are governed by the same refund rules in Section 6 unless stated otherwise at the point of sale.

5.6 Cancellation

You may cancel your subscription at any time through your account settings or via the self-service cancellation portal. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that date. Cancelling does not entitle you to a refund of fees already paid except as set out in Section 6.

5.7 Failed Payments

If a payment fails, we may retry the charge for up to thirty (30) days. If payment cannot be successfully processed within that period, your access to paid features will be suspended. Any fees charged by your bank for declined payments are your responsibility.

5.8 Price Changes

We may change subscription prices from time to time. Price changes will not apply to your current billing cycle. We will notify you of any increase to your renewal price at least thirty (30) days before it takes effect, and you may cancel before the change takes effect if you do not accept it.

6. Refund Policy

Fate operates a strict no-refund policy for the periods and circumstances described below, subject only to your non-excludable statutory rights.

6.1 Trials are non-refundable

Trial fees are charged for immediate access to premium features and are not refundable. You may cancel before the trial ends to avoid the standard subscription charge; cancellation is the mechanism for ending the relationship without further cost. Fate does not provide refunds for trial fees regardless of usage.

6.2 Subscriptions are non-refundable for change of mind

Once a subscription fee has been charged, the fee is non-refundable, and we do not provide pro-rated refunds for any unused portion of a paid period after cancellation, downgrade, or account termination. Examples of situations that do not qualify for a refund include, without limitation: forgetting to cancel before renewal; no longer wanting or using the Service; decreased usage during a billing period; dissatisfaction with content, results, or interpretations (the Service is provided for entertainment and personal reflection); and temporary unavailability of features due to scheduled maintenance or events outside our reasonable control.

6.3 Refunds we do provide

Notwithstanding Section 6.2, you may request a refund in the following limited circumstances: (a) billing error, including duplicate charges or charges in an incorrect amount; (b) unauthorised charge to your payment method by a person who did not have authority to use it (subject to verification); (c) material service failure preventing access to core paid features for a continuous period exceeding seventy-two (72) hours, not caused by scheduled maintenance, your equipment or connection, or events outside our reasonable control, where reported to us in writing within thirty (30) days; or (d) where a refund is required by applicable mandatory consumer law in your jurisdiction (see Section 6.5).

6.4 Add-ons and one-time purchases

Paid add-ons and one-time purchases (including the 30-Day Clearing Path) are non-refundable once the content or feature has been delivered or made available, except where Section 6.3 applies.

6.5 Your statutory consumer rights (not affected by this Section 6)

Nothing in these Terms limits any rights you have under mandatory consumer protection laws in your jurisdiction that cannot be excluded by agreement. In particular:

United Kingdom & European Economic Area: Where you qualify as a consumer, you have a statutory right to cancel a distance contract within 14 days under the UK Consumer Contracts Regulations 2013 / EU Consumer Rights Directive 2011/83/EU. By starting your trial and accessing premium digital content immediately, you expressly request immediate performance of the contract and acknowledge that you will lose the right of withdrawal once performance has begun and the content has been supplied, in accordance with Regulation 37 of the UK Consumer Contracts Regulations 2013 and Article 16(m) of the EU Consumer Rights Directive. If you do not wish to waive this right, do not begin using premium features within the 14-day period.
Australia: Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a refund or remedy for a major failure to comply with the consumer guarantees, and to compensation for any other reasonably foreseeable loss or damage caused by such a failure.
United States: Some US states grant additional rights (e.g., California's Automatic Renewal Law, the federal "click-to-cancel" rule). Where applicable, those rights apply in addition to anything in these Terms.

6.6 How to request a refund

Refund requests must be submitted to contact@getfate.app with your account email, transaction date, amount, payment method, and the reason for the request, together with any supporting evidence. We aim to respond within five (5) business days. Approved refunds are processed to the original payment method within ten (10) business days of approval.

7. Acceptable Use

You agree not to use the Service to: violate any applicable law or regulation; infringe any third party's intellectual property, privacy, or other rights; upload or transmit malware, spam, or harmful content; harass, threaten, or abuse other users or our staff; attempt to access, probe, or disrupt our systems or other users' accounts; reverse engineer, decompile, or extract source code from the Service except as permitted by mandatory law; scrape, copy, or republish Service content other than for personal, non-commercial use; or resell, sublicense, or commercially exploit the Service without our prior written consent.

We may suspend or terminate your account for any breach of this Section 7.

8. Intellectual Property

All content, software, designs, trademarks, logos, and other materials made available through the Service ("Fate Content") are owned by Intuitique LLC or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service and Fate Content solely for personal, non-commercial purposes, subject to these Terms.

You may not: (a) modify or create derivative works of Fate Content; (b) reproduce, distribute, or publicly display Fate Content except as enabled by the Service; (c) remove any copyright, trademark, or proprietary notices; or (d) use Fate Content to train any machine learning or AI model.

9. User Content

You retain ownership of any content you submit to the Service ("User Content"), including birth details, personal questions, photos, partner details (where you provide them for compatibility or synastry analyses), any free-text entries you write in interactive experiences such as the Karmic Clearing release ritual, and other information you provide. By submitting User Content, you grant Fate a worldwide, royalty-free, non-exclusive licence to host, store, process, display, and transmit your User Content solely for the purposes of providing and improving the Service to you, in accordance with our Privacy Policy.

You represent and warrant that: (a) you own or have all necessary rights in your User Content; (b) where you submit information about another person (for example, a partner's birth details), you have that person's permission or otherwise have a lawful basis to do so; (c) your User Content does not violate any law or third-party right; and (d) the information you provide is accurate.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY ASTROLOGICAL CONTENT, COMPATIBILITY ANALYSIS, OR OTHER INTERPRETATION WILL BE ACCURATE OR MEET YOUR EXPECTATIONS.

NOTHING IN THIS SECTION LIMITS ANY RIGHTS YOU HAVE UNDER MANDATORY CONSUMER PROTECTION LAW THAT CANNOT BE EXCLUDED OR LIMITED BY AGREEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTUITIQUE LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. THIS INCLUDES, WITHOUT LIMITATION, ANY LOSS, HARM, OR DAMAGE ARISING FROM RELATIONSHIP, PERSONAL, FINANCIAL, OR OTHER DECISIONS MADE IN RELIANCE ON CONTENT PROVIDED THROUGH THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO FATE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

NOTHING IN THIS SECTION EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT LAWFULLY BE LIMITED.

12. Indemnification

You agree to indemnify, defend, and hold harmless Intuitique LLC, its officers, directors, employees, and agents from and against any third-party claims, damages, losses, and reasonable expenses (including legal fees) arising out of or related to: (a) your breach of these Terms; (b) your User Content (including information about third parties such as partners); (c) your use of the Service in violation of law; or (d) your infringement of any third party's rights. This Section 12 does not apply to consumers to the extent prohibited by applicable consumer law.

13. Termination

You may terminate your account at any time by following the cancellation process in Section 5.6 and deleting your account through your account settings or by contacting contact@getfate.app.

We may suspend or terminate your account, with or without notice, if (a) you breach these Terms; (b) we are required to do so by law; (c) we detect fraud, abuse, or threats to our platform; or (d) we discontinue the Service. Where reasonably possible, we will give advance notice.

On termination: (i) your right to access the Service ends immediately; (ii) provisions which by their nature should survive (including Sections 6, 8, 10, 11, 12, and 14) will survive; and (iii) we will handle your personal data in accordance with our Privacy Policy.

14. Governing Law and Dispute Resolution

14.1 Governing law

These Terms are governed by the laws of the State of Wyoming, United States, excluding its conflict-of-laws rules, except that, where you are a consumer in the UK, EEA, or Australia, you also benefit from any mandatory provisions of the consumer protection law of your country of residence.

14.2 Disputes — US users

If you are located in the United States, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Sheridan, Wyoming or via remote hearing. You and Fate each waive any right to a jury trial and to participate in a class action, class arbitration, or representative proceeding. Either party may bring an individual claim in small-claims court if it qualifies. Either party may seek injunctive or equitable relief in court for intellectual-property disputes or to protect confidential information. You have the right to opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing contact@getfate.app with the subject line "Arbitration Opt-Out."

14.3 Disputes — UK, EEA, Australian, and other non-US users

If you are a consumer outside the United States, you may bring claims in the courts of your country of habitual residence, and we may bring claims against you only in those courts. EU consumers may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr/.

14.4 Time limit

Except where prohibited by law, any claim must be brought within one (1) year of the date you first became aware (or reasonably should have become aware) of the facts giving rise to the claim.

15. General Provisions

Force Majeure. Neither party will be liable for any failure or delay caused by events beyond its reasonable control, including natural disasters, war, terrorism, civil unrest, pandemics, cyberattacks, internet or infrastructure outages, or government actions.

Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, it will be modified to the minimum extent necessary to make it enforceable, or severed; the remaining provisions will continue in full force.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, on notice to you.

Entire agreement. These Terms, together with our Privacy Policy, Cookie Policy, and any plan-specific terms, constitute the entire agreement between you and Fate regarding the Service.

Language. These Terms are provided in English. Where translations are provided for convenience, the English version prevails in the event of any conflict, except where applicable law requires otherwise.
